Terms of Use

Terms governing access to and use of software applications published by MisterJ Dev.

TERMS OF USE

These Terms of Use, together with any applicable app-specific terms, license notices, and the MisterJ Dev Privacy Policy, govern your access to and use of mobile, desktop, web-based, and other software applications published by MisterJ Dev that display or link to these Terms.

The applications covered by these Terms are collectively referred to as the “Apps.”

MisterJ Dev is an independent software developer. In these Terms, “Developer,” “MisterJ Dev,” “we,” “us,” and “our” refer to MisterJ Dev.

“You” and “your” refer to the person who downloads, installs, accesses, or uses an App. If you use an App on behalf of a company, organization, employer, government agency, or other entity, you represent that you are authorized to accept these Terms on its behalf.

1. Acceptance of These Terms

By downloading, installing, accessing, or using an App, you acknowledge that you have read, understood, and agreed to be bound by:

  • These Terms of Use.
  • The MisterJ Dev Privacy Policy.
  • Any app-specific terms or disclosures presented within the App.
  • Any applicable open-source software licenses.
  • The rules and terms of the platform, app store, website, device, or service through which the App is distributed or used.

If you do not agree to these Terms, do not install, access, or use the App.

These Terms form a legally binding agreement between you and MisterJ Dev, subject to any consumer rights that cannot be waived under applicable law.

2. Eligibility

You may use an App only if:

  • You are legally capable of entering into a binding agreement.
  • You are at least 18 years old, or the legal age of majority in your jurisdiction.
  • If you are under the applicable age of majority, you use the App only with the involvement and permission of a parent or legal guardian.
  • You are not prohibited from using the App under applicable law.
  • Your use does not violate any applicable contract, court order, professional obligation, employer policy, institutional rule, or third-party right.

Parents and guardians are responsible for supervising a minor’s use of the Apps.

3. App-Specific Terms

Some Apps may have features, risks, permissions, technical requirements, limitations, or third-party integrations that are not common to all MisterJ Dev Apps.

An App may therefore provide additional terms, warnings, instructions, disclosures, or license conditions.

Those app-specific provisions supplement these Terms.

If an app-specific provision conflicts with these general Terms regarding a feature unique to that App, the more specific provision will control to the extent of the conflict.

4. License Grant

Subject to your compliance with these Terms, MisterJ Dev grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the App on devices that you own or control.

The license is granted solely for:

  • Personal use.
  • Internal business use.
  • Educational use.
  • Testing or evaluation.
  • Other lawful purposes expressly supported by the App.

The App is licensed, not sold.

You acquire no ownership interest in the App, its source code, design, branding, documentation, or other intellectual property.

All rights not expressly granted under these Terms are reserved by MisterJ Dev and the applicable licensors.

5. License Restrictions

Unless applicable law expressly permits otherwise, or an applicable open-source license grants additional rights, you may not:

  • Copy the App except as reasonably necessary for installation, backup, or permitted use.
  • Sell, rent, lease, sublicense, redistribute, or commercially exploit the App.
  • Make the App available over a network for simultaneous use by multiple users unless expressly authorized.
  • Reverse engineer, decompile, disassemble, decode, or attempt to derive the App’s source code.
  • Modify, adapt, translate, or create derivative works from the App.
  • Remove, alter, obscure, or bypass copyright, trademark, attribution, security, licensing, or proprietary notices.
  • Circumvent technical restrictions or usage controls.
  • Use the App to create a competing product through unauthorized copying.
  • Extract or reuse substantial portions of the App’s user interface, documentation, databases, or bundled resources.
  • Misrepresent yourself as the Developer or falsely claim sponsorship, certification, affiliation, or endorsement.
  • Use the App in a way that places an unreasonable load on a third-party service, network, server, device, or platform.
  • Use automated tools to abuse, scrape, disrupt, attack, or overload a service.
  • Distribute modified versions of the App without written authorization.

Restrictions on reverse engineering do not apply where and only to the extent that such restrictions are prohibited by applicable law or where an applicable open-source license expressly permits the activity.

6. Permitted and Lawful Use

You agree to use the Apps only for lawful, authorized, and responsible purposes.

You may not use an App to:

  • Violate any applicable law or regulation.
  • Infringe copyright, trademark, patent, trade-secret, privacy, publicity, database, contractual, or other rights.
  • Access a device, account, network, service, file, or system without authorization.
  • Bypass authentication, encryption, security controls, access restrictions, paywalls, subscription requirements, or digital rights management.
  • Download, copy, modify, or distribute content without the necessary rights or authorization.
  • Monitor, track, identify, record, or surveil another person without a lawful basis and any required consent.
  • Collect personal information unlawfully.
  • Harass, threaten, stalk, defame, exploit, or harm any person.
  • Facilitate fraud, impersonation, phishing, theft, deception, or malicious activity.
  • Create, distribute, install, or facilitate malware, spyware, ransomware, credential-stealing tools, or destructive code.
  • Interfere with or damage devices, vehicles, networks, communications systems, websites, services, or infrastructure.
  • Conceal unlawful activity.
  • Violate the terms or technical restrictions of a third-party platform.
  • Endanger persons, property, public safety, or critical infrastructure.

The availability of a technical capability does not grant you legal permission to use it in a particular way.

You are solely responsible for determining whether your intended use is lawful and authorized.

7. General-Purpose Tools

The Apps may include general-purpose tools for functions such as:

  • Downloading or processing user-selected content.
  • Working with files, URLs, media, documents, or data.
  • Device communication.
  • Diagnostics and testing.
  • Geographic or location-based functions.
  • Bluetooth or local-network communication.
  • Technical calculations.
  • Software, firmware, vehicle, electronic, radio, telecommunications, or equipment-related operations.
  • Productivity, automation, conversion, analysis, or utility functions.

The Apps do not independently verify that you have the legal, contractual, technical, or professional authority to perform an operation.

You must obtain all permissions, licenses, authorizations, ownership rights, and consents required for your use.

8. User-Provided URLs, Files, Data, and Instructions

An App may allow you to submit or select:

  • URLs.
  • Text.
  • Files.
  • Photos.
  • Videos.
  • Audio.
  • Documents.
  • Device information.
  • Location information.
  • Configuration values.
  • Commands.
  • Technical parameters.
  • Other content or instructions.

You retain any rights you hold in the content you provide.

You represent and warrant that:

  • You have the right to provide and process the content.
  • Your use does not violate applicable law.
  • Your use does not violate a third party’s rights.
  • Your instructions do not require unauthorized access or unlawful activity.
  • The content does not contain malicious code intended to damage the App, another device, or a third-party service.

You grant the App permission to access, process, transform, display, transmit, or save the content only as reasonably necessary to perform the function you request.

Unless specifically disclosed otherwise, content processed locally is not uploaded to servers operated by MisterJ Dev.

9. Downloaded and Generated Content

Some Apps may allow you to download, save, export, convert, create, or modify content.

MisterJ Dev does not claim ownership of content lawfully downloaded or generated by you.

You are solely responsible for:

  • The content you select.
  • The source from which the content is obtained.
  • Confirming that downloading or processing is permitted.
  • Obtaining authorization from the content owner where required.
  • Complying with copyright and licensing restrictions.
  • Complying with the terms of the source website or service.
  • Selecting an appropriate storage location.
  • Protecting, reviewing, and backing up downloaded files.
  • Scanning files for malicious or unsafe content.
  • Any subsequent use, publication, modification, or distribution.

The App’s ability to access or process content does not mean that MisterJ Dev owns, endorses, licenses, approves, or authorizes that content.

10. Third-Party Platforms and Content

The Apps may interact with or support content from third-party websites, platforms, applications, devices, or services.

MisterJ Dev is not affiliated with, sponsored by, endorsed by, or officially connected to those third parties unless explicitly stated.

All third-party:

  • Names.
  • Logos.
  • Trademarks.
  • Service marks.
  • Content.
  • Websites.
  • APIs.
  • Devices.
  • Platforms.

remain the property of their respective owners.

You must comply with the applicable third party’s terms, policies, technical restrictions, licenses, and access requirements.

MisterJ Dev is not responsible for:

  • Changes to third-party websites or APIs.
  • A service becoming unsupported.
  • Content being removed or restricted.
  • Account suspension or termination.
  • Blocking, rate limiting, or technical restrictions.
  • Errors or incomplete information supplied by a third party.
  • Third-party security incidents.
  • The legality, safety, accuracy, or availability of external content.
  • Damage caused by files or information obtained from external sources.

11. External Services and Links

An App may display, open, communicate with, or depend upon external services, including:

  • Websites.
  • Mapping or navigation services.
  • Weather or geographic data providers.
  • Cloud-storage providers.
  • Email applications.
  • Device-manufacturer services.
  • Payment or support platforms.
  • App stores.
  • Content platforms.
  • Network or Bluetooth devices.
  • Other third-party systems.

You access external services at your own risk.

MisterJ Dev does not control and is not responsible for the availability, accuracy, security, privacy practices, content, conduct, or terms of external services.

External services may change, suspend, restrict, or discontinue access without notice.

12. Device Permissions

An App may request permissions or protected device capabilities necessary for a particular feature.

These may include:

  • Approximate or precise location.
  • Foreground or background location.
  • Camera.
  • Microphone.
  • Photos, videos, audio, files, documents, or folders.
  • Bluetooth.
  • Nearby devices.
  • Local-network access.
  • Notifications.
  • Contacts or calendar.
  • Device sensors.
  • Foreground services.
  • Clipboard access.
  • Accessibility services.
  • Usage access.
  • Display-over-other-apps permission.
  • Other special or restricted permissions.

The inclusion of a permission in these Terms does not mean that every App requests it.

When required, the relevant App will explain the permission and request it through the mechanisms provided by Android, iOS, Google Play, the Apple App Store, or the applicable platform.

You may deny or revoke a permission through your device settings.

Denying or revoking a permission may prevent the corresponding feature from functioning.

Permission approval does not authorize the App to use the related information for an unrelated or undisclosed purpose.

13. Location-Based Features

Some Apps may use approximate or precise location to provide a requested function.

Location information may be affected by:

  • Device limitations.
  • Signal availability.
  • Network conditions.
  • Mapping-provider data.
  • Satellite availability.
  • User settings.
  • Environmental interference.
  • Operating-system behavior.

Location data may be delayed, incomplete, or inaccurate.

Unless an App expressly states otherwise, location features are not designed for:

  • Emergency response.
  • Life-safety decisions.
  • Aviation or maritime navigation.
  • Professional surveying.
  • Legal boundary determination.
  • Critical dispatch.
  • Any situation where inaccurate information could cause death, injury, property damage, or substantial loss.

You must independently verify important location information using appropriate professional or official sources.

14. Technical, Diagnostic, Automotive, and Equipment-Related Tools

Some Apps may interact with or provide information relating to:

  • Vehicles.
  • Electronic control units.
  • Firmware.
  • Diagnostic interfaces.
  • Radio or telecommunications equipment.
  • Bluetooth devices.
  • Electrical or electronic systems.
  • Computer networks.
  • Industrial equipment.
  • Configuration files.
  • Hardware programming.
  • Technical measurements or calculations.

Such functions may carry a risk of:

  • Equipment malfunction.
  • Data loss.
  • Configuration corruption.
  • Device lockout.
  • Loss of warranty.
  • Regulatory noncompliance.
  • Vehicle or equipment damage.
  • Network interruption.
  • Personal injury.
  • Property damage.

Before performing a technical operation, you are responsible for:

  • Confirming compatibility.
  • Creating verified backups.
  • Maintaining stable power.
  • Following the manufacturer’s instructions.
  • Using appropriate equipment.
  • Confirming that you are authorized to modify the device.
  • Understanding recovery procedures.
  • Complying with safety, emissions, communications, licensing, and regulatory requirements.
  • Consulting a qualified professional where appropriate.

Do not rely on an App as your only source of technical, diagnostic, safety, or repair information.

MisterJ Dev is not responsible for damage or loss resulting from incorrect configuration, incompatible hardware, interruption, user error, third-party equipment, or unauthorized modification.

15. No Safety-Critical Reliance

Unless an App expressly states otherwise, the Apps are not designed, certified, or intended for use in:

  • Medical diagnosis or treatment.
  • Emergency response.
  • Life-support systems.
  • Nuclear facilities.
  • Aviation control.
  • Autonomous vehicle control.
  • Public-safety dispatch.
  • Critical infrastructure control.
  • Military targeting.
  • Professional navigation.
  • Any system in which failure could reasonably result in death, personal injury, environmental harm, or substantial property damage.

You must not rely exclusively on an App for any safety-critical decision.

16. User Safety

You must not operate an App while driving, operating machinery, climbing, performing electrical work, working at height, or engaging in any activity where distraction may cause injury or damage.

Use hands-free functions where permitted and appropriate.

Follow all applicable safety requirements and professional procedures.

MisterJ Dev is not responsible for injury or damage caused by distracted, unsafe, negligent, or unauthorized use.

17. Backups and Data Loss

Before using an App to modify, convert, overwrite, flash, transfer, delete, or process important data, you must create and verify an independent backup.

You are responsible for maintaining copies of:

  • Original files.
  • Configurations.
  • Firmware.
  • Device data.
  • Credentials.
  • Recovery information.
  • Other important content.

MisterJ Dev does not guarantee that an App can recover lost, corrupted, deleted, overwritten, or incompatible data.

18. Internet, Carrier, and Third-Party Charges

Use of an App may require:

  • Internet access.
  • Mobile data.
  • SMS or telephone service.
  • Cloud storage.
  • A paid third-party account.
  • Specialized equipment.
  • Subscription services.
  • App-store purchases.
  • Other third-party products or services.

You are responsible for all fees, charges, taxes, equipment, and connectivity required for your use.

MisterJ Dev is not responsible for charges imposed by carriers, internet providers, app stores, payment processors, equipment providers, or other third parties.

19. Updates and Compatibility

MisterJ Dev may release updates, bug fixes, security patches, modifications, or new versions.

Updates may:

  • Add or remove features.
  • Change compatibility.
  • Modify permissions.
  • Change supported websites, devices, or formats.
  • Correct errors.
  • Address security issues.
  • Be required for continued operation.

We do not guarantee compatibility with every:

  • Device.
  • Operating-system version.
  • Manufacturer modification.
  • Website.
  • API.
  • File format.
  • Network.
  • Service.
  • Accessory.
  • Hardware interface.

Third-party changes may cause a feature to stop working without notice.

You are responsible for evaluating updates and maintaining a compatible environment.

20. Availability, Modification, and Discontinuation

MisterJ Dev may modify, suspend, limit, replace, or discontinue an App or feature at any time.

Reasons may include:

  • Technical limitations.
  • Security concerns.
  • Legal or policy requirements.
  • Third-party service changes.
  • Lack of compatibility.
  • Lack of resources.
  • App-store decisions.
  • Maintenance.
  • Business or development priorities.

To the extent permitted by law, MisterJ Dev is not obligated to maintain or continue any App indefinitely.

Discontinuation does not entitle you to compensation except where required by applicable law or an applicable app-store refund policy.

21. Beta, Experimental, and Preview Features

An App or feature labeled beta, experimental, preview, test, development, early access, or similar may be incomplete and less reliable than a production feature.

Such features may:

  • Contain errors.
  • Change without notice.
  • Produce incorrect results.
  • Lose compatibility.
  • Be removed.
  • Cause data loss or unexpected behavior.

You use experimental features at your own risk and should not rely on them for important or safety-critical operations.

22. Support

MisterJ Dev may provide support at its discretion through:

misterj.dev@gmail.com

Support is not guaranteed and may be limited by:

  • Available time.
  • Technical feasibility.
  • Device compatibility.
  • App age.
  • Third-party service changes.
  • Security considerations.
  • Lack of sufficient information.

You may be asked to provide logs, screenshots, device details, or other information voluntarily.

Do not send passwords, private keys, authentication tokens, payment-card information, government identification numbers, or other unnecessary sensitive information.

23. Feedback and Feature Requests

You may voluntarily submit:

  • Feedback.
  • Suggestions.
  • Bug reports.
  • Feature ideas.
  • Requests for additional supported sites, devices, services, or formats.
  • Other recommendations.

You retain ownership of any original material contained in your feedback.

However, you grant MisterJ Dev a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, implement, distribute, and otherwise use your feedback for any lawful purpose without compensation or attribution.

This license does not grant MisterJ Dev ownership of your unrelated personal information.

You should not submit confidential information as feedback.

24. Voluntary Support and Donations

Some Apps may provide an optional way to support development.

A contribution or donation:

  • Is voluntary.
  • Does not purchase ownership in the App.
  • Does not create an employment, agency, partnership, investment, or fiduciary relationship.
  • Does not guarantee a feature, update, response, or development schedule.
  • Does not provide influence over development decisions unless explicitly agreed in writing.
  • May be processed by a third-party payment or support platform.

Payments are subject to the payment provider’s terms, refund policies, fees, and privacy practices.

Unless required by law or stated otherwise by the payment provider, voluntary contributions may be non-refundable.

25. Intellectual Property

The Apps and their original components, including their:

  • Software.
  • Source and object code.
  • Design.
  • Layout.
  • User interface.
  • Graphics.
  • Documentation.
  • Branding.
  • Logos.
  • Names.
  • Original text.
  • Databases.
  • Compilation and arrangement.

are owned by or licensed to MisterJ Dev and are protected by applicable intellectual-property laws.

Third-party content, trademarks, libraries, and open-source components remain the property of their respective owners.

No right to use the MisterJ Dev name, branding, logo, or other identifying materials is granted except as expressly authorized in writing.

26. Open-Source Software

The Apps may include open-source software.

Open-source components are governed by their applicable licenses.

Where an open-source license conflicts with these Terms regarding the relevant component, the open-source license controls.

Required notices, attribution, license text, or source-code information may be provided:

  • Within the App.
  • In bundled documentation.
  • In a source-code repository.
  • On a website.
  • Upon valid request where required by the applicable license.

27. Privacy

Your use of the Apps is also governed by the MisterJ Dev Privacy Policy.

The Privacy Policy explains how an App may access, process, store, transmit, or share information.

If an App uses a sensitive permission or handles information differently from the general Privacy Policy, an app-specific disclosure may also apply.

You should review the Privacy Policy before using the App.

28. Security

You may not attempt to:

  • Circumvent App security.
  • Exploit vulnerabilities.
  • Introduce malicious code.
  • Interfere with another user.
  • Gain unauthorized access.
  • Extract credentials.
  • Manipulate licensing or integrity checks.
  • Use the App to attack a third-party service.
  • Publish an uncorrected vulnerability in a manner that creates an unreasonable risk of harm.

Please provide enough information to reproduce and evaluate the issue responsibly.

29. Suspension and Termination

These Terms remain effective until terminated.

Your license and right to use an App terminate automatically if you materially violate these Terms.

MisterJ Dev may also suspend or terminate access to an App or feature where reasonably necessary to:

  • Protect users or third parties.
  • Address unlawful conduct.
  • Address security threats.
  • Comply with legal obligations.
  • Comply with app-store requirements.
  • Prevent abuse.
  • Protect intellectual property.

Upon termination, you must stop using the App and delete copies in your possession, except where retention is permitted by applicable law.

Termination does not affect provisions that by their nature should survive, including:

  • Intellectual-property provisions.
  • User responsibility.
  • Disclaimers.
  • Limitations of liability.
  • Indemnification.
  • Governing law.
  • Dispute provisions.

30. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Apps are provided on an “as is” and “as available” basis.

MisterJ Dev disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of:

  • Merchantability.
  • Fitness for a particular purpose.
  • Title.
  • Non-infringement.
  • Accuracy.
  • Reliability.
  • Availability.
  • Compatibility.
  • Security.
  • Quiet enjoyment.
  • Error-free operation.

MisterJ Dev does not warrant that:

  • An App will meet your requirements.
  • An App will always be available.
  • An App will be uninterrupted or error-free.
  • Defects will be corrected.
  • Results will be accurate or complete.
  • External content will be lawful or safe.
  • Every device, website, service, file, or format will remain supported.
  • Downloaded files will be free from malware.
  • Data will not be lost.
  • Third-party services will remain available.
  • An App will be suitable for professional or safety-critical use.

Some jurisdictions do not allow the exclusion of certain implied warranties. In those jurisdictions, the exclusions apply only to the maximum extent permitted by law.

31. Limitation of Liability

To the fullest extent permitted by applicable law, MisterJ Dev and its contributors, licensors, contractors, and service providers will not be liable for any:

  • Indirect damages.
  • Incidental damages.
  • Special damages.
  • Consequential damages.
  • Exemplary damages.
  • Punitive damages.
  • Loss of profits.
  • Loss of revenue.
  • Loss of business.
  • Loss of opportunity.
  • Loss of goodwill.
  • Loss, disclosure, or corruption of data.
  • Device, vehicle, equipment, or property damage.
  • Business interruption.
  • Personal injury resulting from unauthorized, unsafe, or negligent use.
  • Third-party claims arising from your conduct.

This limitation applies to damages arising from or relating to:

  • Use or inability to use an App.
  • Incorrect, incomplete, or delayed results.
  • Downloaded or third-party content.
  • User error.
  • Unauthorized use.
  • Device permissions.
  • Location or mapping inaccuracies.
  • Technical operations.
  • Firmware, configuration, or file modification.
  • Third-party services or hardware.
  • Security incidents outside MisterJ Dev’s reasonable control.
  • Changes to operating systems, websites, services, APIs, or devices.
  • Suspension or discontinuation of an App.

Where liability cannot be excluded, MisterJ Dev’s total aggregate liability arising from or related to an App will not exceed the greater of:

  • The amount you paid directly to MisterJ Dev for the affected App during the twelve months preceding the event giving rise to the claim; or
  • Ten United States dollars, or the equivalent in local currency.

This limitation does not apply to liability that cannot legally be excluded or limited.

Mandatory consumer rights remain unaffected.

32. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless MisterJ Dev and its contributors, licensors, contractors, and service providers from claims, liabilities, damages, judgments, losses, costs, and reasonable legal fees arising from or related to:

  • Your use or misuse of an App.
  • Your violation of these Terms.
  • Your violation of applicable law.
  • Your violation of a third party’s rights.
  • Content you access, submit, download, modify, publish, or distribute.
  • Your unauthorized access to a device, account, network, service, or system.
  • Damage caused by your instructions or technical operations.
  • A claim that your use infringed intellectual-property, privacy, contractual, or other rights.

This provision does not require indemnification for conduct solely attributable to MisterJ Dev where such an obligation would be prohibited by law.

33. Compliance With Laws

You are responsible for complying with all laws applicable to your use, including laws concerning:

  • Copyright and intellectual property.
  • Privacy and data protection.
  • Computer misuse and unauthorized access.
  • Telecommunications and radio equipment.
  • Vehicle and emissions regulation.
  • Consumer protection.
  • Export controls and sanctions.
  • Location tracking and surveillance.
  • Recording and communications privacy.
  • Professional licensing.
  • Safety and environmental protection.

The Apps are not legal advice.

You should consult a qualified professional when the legality or safety of an intended operation is uncertain.

34. Export Controls and Sanctions

You may not use, export, re-export, transfer, or make an App available in violation of applicable export-control, trade-sanction, or import laws.

You represent that you are not prohibited from receiving or using the App under applicable trade restrictions.

You may not use an App for prohibited military, weapons, surveillance, or other restricted purposes.

35. Government and Institutional Users

Government, military, educational, corporate, and institutional users are responsible for determining whether an App satisfies their:

  • Procurement requirements.
  • Security policies.
  • Privacy rules.
  • Records-management obligations.
  • Accessibility standards.
  • Technical requirements.
  • Regulatory obligations.

Use of an App does not create a contractual service-level commitment unless expressly agreed in a separate written contract signed by MisterJ Dev.

36. App Store and Platform Terms

If you obtain an App through an app store or distribution platform, your use may also be governed by that platform’s terms.

In the event of a conflict:

  • Mandatory platform terms apply to the extent required by the platform.
  • Mandatory consumer law applies regardless of these Terms.
  • These Terms govern the relationship between you and MisterJ Dev to the remaining extent.

The app store is not responsible for obligations that belong exclusively to MisterJ Dev, except where its own terms expressly state otherwise.

37. Additional Terms for Apple App Store Users

This section applies when an App is downloaded through the Apple App Store.

37.1 Parties

These Terms are between you and MisterJ Dev, not Apple.

MisterJ Dev, not Apple, is solely responsible for the App and its content, subject to these Terms and applicable law.

37.2 Scope of License

Your license is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and applicable Usage Rules.

The App may also be accessed and used by accounts associated with you through features authorized by Apple, such as Family Sharing or volume purchasing, where applicable.

37.3 Maintenance and Support

MisterJ Dev is responsible for any maintenance or support expressly offered for the App.

Apple has no obligation to provide maintenance or support services for the App.

37.4 Warranty

If the App fails to conform to an applicable warranty that cannot legally be excluded, you may notify Apple.

Where applicable under Apple’s rules, Apple may refund the purchase price paid for the App.

To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.

37.5 Product Claims

MisterJ Dev, not Apple, is responsible for addressing claims relating to:

  • Product liability.
  • Regulatory compliance.
  • Consumer-protection claims.
  • Privacy claims.
  • Claims arising under these Terms.

37.6 Intellectual-Property Claims

If a third party claims that the App or your authorized possession and use of it infringes intellectual-property rights, MisterJ Dev, not Apple, is responsible for investigating, defending, settling, or resolving the claim to the extent required by applicable law.

37.7 Legal Compliance

You represent that:

  • You are not located in a country or region subject to an applicable government embargo that prohibits your receipt of the App.
  • You are not listed on an applicable government list of prohibited or restricted parties.

37.9 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to an App distributed through the Apple App Store.

Upon your acceptance of these Terms, Apple has the right to enforce the applicable provisions against you as a third-party beneficiary.

38. Google Play Users

If you obtain an App through Google Play:

  • These Terms are between you and MisterJ Dev.
  • Google is not responsible for the App except as expressly provided in Google’s own terms.
  • Your use remains subject to the Google Play Terms of Service and applicable Google Play policies.
  • Refunds, billing, subscriptions, and purchases processed by Google may also be governed by Google’s applicable rules.
  • Google may suspend or remove an App from Google Play according to its policies.
  • Removal from Google Play does not necessarily remove copies already installed on your device, although continued functionality is not guaranteed.

39. Governing Law

These Terms are governed by the laws of the Dominican Republic, without regard to conflict-of-law principles.

This governing-law provision does not deprive you of mandatory consumer protections applicable in your country of residence.

Where applicable law grants you the right to bring a claim in your local courts, these Terms do not eliminate that right.

40. Informal Dispute Resolution

Before filing a formal legal claim, you agree to make a reasonable effort to contact MisterJ Dev at:

Your notice should include:

  • Your name.
  • The relevant App.
  • A description of the dispute.
  • The action or resolution requested.
  • Any supporting information reasonably necessary to evaluate the issue.

MisterJ Dev will have a reasonable opportunity to review and respond.

This section does not prevent either party from seeking urgent injunctive relief, reporting unlawful conduct, exercising mandatory consumer rights, or filing a claim before a limitation period expires.

41. Jurisdiction

Subject to mandatory consumer rights and applicable law, disputes that cannot be resolved informally will be submitted to the competent courts of the Dominican Republic.

Nothing in this section prevents a consumer from using another court or dispute-resolution mechanism where applicable law grants a non-waivable right to do so.

42. Force Majeure

MisterJ Dev will not be responsible for delay, interruption, or failure caused by events beyond its reasonable control, including:

  • Natural disasters.
  • Power failures.
  • Internet or telecommunications outages.
  • Cyberattacks.
  • Government action.
  • War, civil unrest, or terrorism.
  • Labor disputes.
  • Public-health emergencies.
  • App-store outages or decisions.
  • Third-party service failures.
  • Changes to laws, platforms, APIs, devices, or operating systems.

43. Assignment

You may not assign or transfer your rights or obligations under these Terms without prior written consent from MisterJ Dev.

MisterJ Dev may assign these Terms in connection with a reorganization, transfer of an App, sale of assets, merger, acquisition, or change in business structure, subject to applicable law and any required notice.

44. No Agency or Partnership

These Terms do not create an:

  • Employment relationship.
  • Agency.
  • Partnership.
  • Joint venture.
  • Franchise.
  • Fiduciary relationship.

Neither party has authority to bind the other unless expressly agreed in writing.

45. Severability

If a provision of these Terms is found to be unlawful, invalid, or unenforceable, it will be interpreted, limited, or modified to the minimum extent necessary.

The remaining provisions will continue in effect.

46. No Waiver

Failure to enforce a provision does not waive the right to enforce it later.

A waiver is effective only when made expressly and in writing by the party granting it.

47. Entire Agreement

These Terms, together with the Privacy Policy, applicable app-specific terms, and incorporated license notices, constitute the entire agreement between you and MisterJ Dev concerning your use of the App.

They replace prior discussions or agreements concerning the same subject matter, except for a separate written agreement expressly signed by MisterJ Dev.

48. Headings

Section headings are provided for convenience and do not affect the interpretation of these Terms.

49. Language

These Terms are written in English.

Translations may be provided for convenience.

If a translation conflicts with the English version, the English version will control to the extent permitted by applicable law.

50. Changes to These Terms

MisterJ Dev may update these Terms to reflect:

  • New or modified App features.
  • Legal or regulatory changes.
  • App-store policy changes.
  • Security requirements.
  • Changes to third-party services.
  • Clarifications or corrections.

The updated Terms will display a revised “Last Updated” date.

Material changes may also be communicated through:

  • An in-app notice.
  • An app-store listing.
  • A website.
  • An update screen.
  • Another reasonable method.

Where required by law, consent will be requested before materially different terms apply.

Your continued use after non-material changes means the updated Terms apply to future use.
